1. About DuoSwim

DuoSwim provides structured swim workouts, training plans, pacing guidance, and related coaching content through the website and app. By using DuoSwim, you agree to these Terms.

2. Acceptance and updates

By creating an account, accessing the app, or using our website, you accept these Terms. We may update these Terms from time to time. Continued use after updates means you accept the updated Terms.

3. Eligibility

You must be at least 16 years old and legally able to enter into a binding contract. DuoSwim is for personal consumer use. Commercial use is not permitted without written approval.

4. Accounts and credentials

You are responsible for account activity and keeping your login credentials secure. You agree to provide accurate account information and to update it as needed.

5. Subscriptions, trials, and billing

Paid features may require a subscription. If you start a trial, billing starts when the trial ends unless canceled before renewal. Subscriptions auto-renew until canceled. App-store purchases are managed via Apple App Store or Google Play billing terms.

Fees, pricing, offer eligibility, and renewal timing are shown at checkout and may vary by region.

6. Acceptable use

You agree not to:

• • Use DuoSwim for unlawful, abusive, fraudulent, or harmful activity
• • Upload malicious code, spam, or unauthorized promotional content
• • Infringe intellectual property or impersonate another person/entity
• • Attempt to interfere with platform security, performance, or availability

7. User content and moderation

If you submit content (for example in chat, feedback, or community areas), you retain ownership but grant DuoSwim a license to host and display that content to operate the service. We may remove content that violates these Terms.

8. Intellectual property

DuoSwim content, plans, branding, software, and materials are protected by intellectual property laws and remain DuoSwim property or licensed property. You receive a limited, non-transferable license for personal use only.

9. Third-party services

DuoSwim may integrate with or link to third-party services (including Apple, Google, Garmin, and Strava). We are not responsible for third-party content, policies, or service availability.

10. Health and safety disclaimer

DuoSwim is not medical advice and does not replace professional medical guidance. Exercise carries risk. You are responsible for deciding whether training is appropriate for your condition. If you have any medical concerns, seek advice from a qualified clinician before starting or continuing training.

11. Disclaimer of warranties

DuoSwim is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, DuoSwim is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the services.

13. Suspension and termination

We may suspend or terminate accounts for violations of these Terms, suspected abuse, fraud, or security risks. You can stop using DuoSwim at any time.

14. Governing law

These Terms are governed by the laws of the United Kingdom. Disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of the United Kingdom.
